How the law works
- Zero hours workers are entitled to 5.6 weeks holiday per year
- Holiday pay = average weekly earnings over last 52 worked weeks
- Blank (zero earning) weeks are excluded from the average
- Accrued untaken holiday must be paid on contract ending
- 12.07% method ruled unlawful — Harpur v Brazel (2022)

What to do if your employer disputes this
Contact ACAS on 0300 123 1100 for free advice. If your employer refuses to pay accrued holiday, you can bring an unlawful deduction from wages claim at an employment tribunal within 3 months minus 1 day of the last deduction.
